EveryStreet (the “Service”) is a web app operated by Jeremiah Chamberland, doing business as EveryStreet (“EveryStreet,” “we,” “us”). These Terms of Service (the “Terms”) are a binding agreement between you and us. By creating an account, ticking the agreement box, or using the Service, you accept these Terms and our Privacy Policy. If you do not accept them, do not use the Service.
If you use the Service on behalf of a church or other organization (a “Church”), you confirm that you are authorized to accept these Terms for it, and “you” includes that Church.
You are responsible for your password and for everything done through your account. Tell us promptly at geteverystreet@gmail.com if you think someone else has used it. Do not share your login.
Each Church decides who may join and what role each person has (for example administrator, Bus Director, captain, worker, driver, or soul winner). A Church’s administrators can see and manage the Church’s information, add or remove members, and change roles. What you can see inside a Church depends on the role the Church gives you. A “basic” account that is not connected to a Church keeps a private notebook that only you can see, until a Church approves you.
Church Data means everything a Church or its members put into the Service: names, addresses, phone numbers, family and age details, visit notes, decisions, riders, routes, attendance, messages, photos, and documents such as permission forms. As between you and us, the Church owns its Church Data.
You give us a limited, non-exclusive permission to store, copy, display, and process Church Data only so we can run, secure, support, and improve the Service for you. We do not sell Church Data, we do not use it for advertising, and we do not share it except as described in the Privacy Policy or as you direct.
For personal information about the people a Church visits, the Church decides why and how it is used, and we act as its service provider, following the Church’s instructions through the settings and features of the app.
The EveryStreet coverage map (one exception you should know about). Each time a street is marked as knocked, in your Church or in a private notebook, the app saves a line on the map with the date. We combine these knocked-street lines from all churches into one national coverage map, so we can see how much of the country has been reached. Only the owner of EveryStreet can see this combined map. It uses only the line on the map and the date it was knocked. It never includes names, addresses of houses, phone numbers, notes, decisions, riders, visits, or the name of the person who knocked the street, and it is not shown to other churches. We do not sell it, do not use it for advertising, and will not make any part of it public without first giving notice under Section 16. Using the Service includes this use; it is part of the limited permission in the paragraph above.
Recording information about real people is a serious trust. By using the Service you agree that you and your Church will:
You may not: break the law or anyone’s rights; upload harmful code or try to break, probe, or overload the Service; try to see another Church’s information or bypass a role or permission; scrape or resell the Service; create accounts with false or throw-away email addresses or by automated means; or use the Service to send spam or to store content that is unlawful or abusive. We may suspend or remove access that puts people or the Service at risk.
The Service depends on other companies, including Supabase (database, sign-in, and file storage), Cloudflare (hosting and robot checks), Google (maps and email), and your device’s push-notification service. Use of Google Maps is also subject to Google’s terms. We do not control those services and are not responsible for their outages or changes, though we choose them with care. See the Privacy Policy for details.
EveryStreet is currently offered to participating churches at no charge under a “Founding church” plan. We may introduce paid plans in the future. We will not charge you unless you choose a paid plan, and we will give at least 30 days’ written notice (by email or in the app) before any change to pricing or to what a free plan includes. If you do not want a change, you may stop using the Service and export your information first.
We work to keep the Service running and your information safe, but the Service is early-stage software and may be interrupted, changed, or contain errors. Do not rely on EveryStreet as your only copy of information you cannot afford to lose. We make reasonable efforts to protect and back up data, but we do not guarantee that data will never be lost. The Service is not an emergency service and is not designed for medical, safety-critical, or legal record-keeping needs.
You may stop using the Service at any time. A Church administrator may ask us to close the Church’s workspace, and individuals may ask us to delete their own account, by writing to geteverystreet@gmail.com. After a workspace or account is closed we will delete or anonymize the related information within a reasonable time (normally within 30 days), except where we must keep it to follow the law, resolve disputes, or prevent fraud, and except for copies in routine backups that expire on their normal schedule. The one exception is the coverage map in Section 4: when a Church closes, we remove every link between its knocked-street lines and the Church, and we may keep the plain lines and dates, because by then they show only that a street was walked and identify no person or church.
We may suspend or end your access if you break these Terms, if we must to follow the law, or if we stop offering the Service. Where it is reasonable and safe, we will give you notice and a chance to export your information first.
We own the Service, including its software, design, name, and logo. These Terms give you a limited, revocable, non-transferable right to use the Service for your Church’s ministry. A Church’s own name and logo remain the Church’s. If you send us ideas or feedback, we may use them without owing you anything.
To the fullest extent the law allows, the Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not promise that the Service will be uninterrupted, error-free, or completely secure, or that map locations, route timings, or addresses will be accurate.
To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost data, profits, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the greater of (a) the amount you paid us for the Service in the 12 months before the claim or (b) $100. Some places do not allow certain limits, so parts of this section may not apply to you. Nothing in these Terms limits liability that cannot be limited by law.
To the extent the law allows, a Church agrees to defend and reimburse us for claims brought by third parties that arise from the Church’s Church Data or from the Church’s members using the Service in breach of these Terms (for example, recording a person’s information without the permission that the law requires). This does not apply to claims caused by our own negligence or misconduct.
These Terms are governed by the laws of the State of Maryland, without regard to its conflict-of-law rules. Before filing a claim, each side will first try in good faith to resolve the dispute informally by writing to the other for at least 30 days. Any claim that is not resolved must be brought in the state or federal courts located in the State of Maryland, and you and we consent to those courts. Either side may bring an individual claim in small-claims court where it qualifies. Because we may serve churches in many states, nothing in these Terms is meant to remove any right you have under the laws of the state where you live that cannot be waived.
We may update these Terms as the Service grows. If a change is significant we will tell you in the app or by email before it takes effect (at least 14 days ahead where practical). Using the Service after the effective date means you accept the updated Terms. The version and date at the top of this page tell you which Terms are current.
These Terms and the Privacy Policy are the whole agreement between you and us about the Service. If a part is found unenforceable, the rest stays in effect. If we do not enforce a term right away, we have not given it up. You may not transfer your rights under these Terms without our written consent. We may transfer ours to a successor, including a company or nonprofit that takes over the Service, as long as it agrees to honor these Terms and the Privacy Policy. We are not responsible for delays caused by events outside our reasonable control.
